Air Quality

For any project involving an aggregate one-half acre or more of Disturbed Area, a Dust Control Plan must be submitted to the Nye County Air Quality Program Administrator along with the zone review, building permit application, conditional use permit application, zoning change application, or site development plan. The Dust Control Plan shall specify the use of Best Practical Methods to control the generation of fugitive dust from each construction activity. |

Any person engaged in activities involving the handling, transportation or storage of any material; dismantling or demolition of buildings; grubbing; grading; clearing of land; public or private construction; the operation of machines and equipment; the grading of roads; trenching operations; the operation and use of unpaved parking facilities; and the organization and supervision of public outdoor events shall take all reasonable precautions to prevent fugitive dust from becoming airborne from such activities at all times. Reasonable precautions may include, but are not limited to, sprinkling, compacting, enclosure, chemical or asphalt sealing, cleaning up, sweeping, soil amendments, addition of non-emissible covers or such other measures as Nye County may specify. All control measures selected must be maintained to ensure the visible emissions do not exceed the 20% opacity limit as described in Section 15.28.150.A of the county dust regulation. |

This Regulation shall not apply to emergency activities conducted by any Fire Department, utility, or government agency which are necessary to protect the health, safety and welfare of the public. The following construction type activities do not require a Dust Control Plan:1. Landscaping by an individual at his/her place of residence; 2. Emergency maintenance activities conducted by government agencies on publicly maintained roads, road shoulders, rights-of-way and on public flood control facilities; and 3. Dust Palliative application projects conducted solely for the purpose of compliance with Open Areas and Vacant Lots subsection of this ordinance, wherein no grade elevation changes, no soil or rock is imported or exported, or no cut and fill operations occur. Importing of gravel or rock for use as a dust palliative is allowed under this subsection. |

This ensures that any use you make of your property will not have a negative impact on neighboring properties or property values. The Master Plan, or Land Use Plan, is an overall development guide for all areas of the Pahrump Regional Planning District. It provides the appropriate mix of residential, commercial, and industrial uses in a logically transitioned pattern. It is used to decide if proposed development is in conformance with the plan. Zoning is the division of the county into districts for the purpose of regulating the use of private land. It is, also, a legal entitlement to develop your property within the permitted uses specified in the zoning code. (This only applies to the Pahrump Regional Planning District) |

The Board of County Commissioners (BOCC) are elected officials who are responsible for establishing and maintaining the governance of unincorporated Nye County, including land development. The BOCC are elected from five electoral districts and appoint the members of the Regional Planning Commission. The Pahrump Regional Planning Commission is empowered by the BOCC to make final development decisions on many land use applications, and make recommendations on nonconforming zone change requests. The BOCC is the final authority on all zoning issues, including appealed decisions from the PRPC. |

Any decision made by the PRPC can be appealed to the Board of County Commissioners (BOCC). Appeals must be filed in writing with the Planning Department within 30 days from the PRPC meeting and are scheduled for a hearing by the BOCC approximately one month later. We also administer the transportation programs for Goldfield, Silver Peak and Fish Lake Valley in Esmeralda County. Goldfield clients are transported to Tonopah on Tuesday and Thursday. Fish Lake Valley clients are transported to Tonopah on Tuesday and to Bishop, CA on Thursday. Transportation is provided from Silver Peak to Tonopah on Wednesday. Non-emergency long distance medical transportation is provided to larger cities for medical appointments. Suggested donations depend on destination. Rides are provided to non-seniors on a space available basis. We are contracted with Logisticare to provide medical transportation to Nevada Medicaid clients. |

An annual tax exemption is available to any veteran with wartime service (including in-theater service during the Persian Gulf War, Afghanistan and Iraqi Wars). To obtain this exemption, take a copy of your DD214 or discharge papers to your local County Assessor. The exemption can be applied to a veteran’s vehicle privilege tax or real property tax. The exemption cannot be split between the two. To obtain the exact amount of this benefit, contact your County Assessor. Veterans may also “donate” their exempted tax directly to the Nevada Veterans’ Home Account, which will contribute the amount toward the operation of a Veterans’ Home in Nevada. |

Nevada offers a property tax exemption to any veteran with a service-connected disability of 60% or more. The amounts of exemption that are or will be available to disabled veterans varies from $6,250 to $20,000 of assessed valuation, depending on the percentage of disability and the year filed. To qualify, the veteran must have an honorable separation from the service and be a resident of Nevada.
